Cross-border family disputes

International families generate particular complexities due to the frequent requirement to consider different (and often conflicting) legal and cultural principles. Working with our network of foreign lawyers and advisers we can help our clients to pre-empt problems as far as possible and navigate difficulties as they arise.

Sectors and Services

Cross-border family disputes

What we do:

The issues that we deal with on a daily basis are wide ranging covering relationships from start to finish and many life events in between.  We can assist with the negotiation and preparation of marital and cohabitation agreements at the start of a relationship and help clients achieve resolution of the disputes which often arise on separation whether relating to money or children.

We are skilled in both court work and other processes such as mediation, arbitration and collaborative working.  We also advise third parties such as trustees when they become embroiled in family disputes.

Some of the questions we can help you answer include:

  • Do I need an English pre-nuptial agreement (a “pre-nup”) if I am already having a marriage contract?
  • Does it make a difference where I get divorced?
  • One of my beneficiaries is going through an English divorce what should I do?  Are the trust assets at risk?
  • My marriage is in difficulty can I return with the children to my country of origin to be close to my family?
  • I am thinking of adopting a child from abroad or entering into a foreign surrogacy arrangement is this straightforward?
  • Are there any adverse tax consequences associated with payments or property transfers made on divorce?
