Jesper advises on all aspects of employment law and acts for medium sized commercial and charity clients, as well as for senior executives, dealing with all employment and related commercial matters.
He provides advice on general employee relations matters, such as preparing employment contracts or service agreements for senior employees, advising on worker status issues, working time and holiday pay, as well as supporting clients through grievance and disciplinary processes and preparing work place policies. Jesper often works alongside the in-house senior HR professional in supporting the organisation.
For business clients (including charities), Jesper’s expertise includes dealing with business reorganisations, often involving redundancy or Transfer of Undertakings (Protection of Employment) regulations (TUPE) transfer consultation and negotiating employment related indemnities on business sales and out-sourcing arrangements.
Jesper undertakes all types of litigation in the Employment Tribunal, whether pursuing or defending claims for unfair dismissal, whistle-blowing and discrimination claims under the Equality Act 2010, such as discrimination by reason of sex, race, disability, age, religious belief and sexual orientation. He always takes a very pragmatic and commercial approach to litigation and what this might achieve for the client.
A significant amount of Jesper’s time is spent negotiating settlement agreements or seeking other mediated solutions to work place issues for businesses. Clients also include senior directors and executives who either wish or have been asked to exit their organisation. Advice in this area covers all aspects of the structure of the termination and taxation of a financial settlement, as well as issues around confidentiality, reputational protection and post termination restrictions.
