Property disputes partner Simon Painter, answers a reader’s question regarding the use of private roads in an article for The Sunday Times in which he sets out possible options for obtaining access.

The first step is to ascertain who owns the road. Check the Land Registry to find out if the road is registered and, if so, the name and address of the registered owner. The registered title to the road may also indicate who has the legal right to use the road and you should check to see if your property is included as one of those that does.
