Designation of an age verification regulator: An exercise in futility?

At the end of last year the UK Government formally proposed that the British Board of Film Classification (‘BBFC’) be the age verification regulator in relation to online pornography required under Part 3 of the UK Digital Economy Act 2017. Will Richmond-Coggan looks at the designation proposal and the supplementary evidence provided by the Government as to the alleged need for the Government’s action in this sector, and examines some of the concerns as to its necessity and potential effectiveness.
