Charities Counsel Nicola Evans’ comments on a recent Supreme Court ruling have been picked up by Charity Times, EG, Charity Tax Group, Civil Society News, The Lawyer’s Litigation Tracker and Practical Law.

The London Borough of Merton had contested claims by Nuffield Health that it was entitled to 80% charity tax relief on non-domestic rates for the gym; however, the Supreme Court backed an earlier High Court decision that it is not the individual locations that need to be considered for this requirement but rather the overall work of the charity.

BDB Pitmans acted on behalf of Nuffield Health in the case, which is expected to have far-reaching implications for all charities operating across a number of sites.

Nicola Evans states:

‘The judgement should be helpful for charities and rating authorities alike in setting out a clear test to apply for mandatory charity rates relief.’
