What does the Government’s white paper on the future UK/EU relationship imply? While the paper notes the end of the jurisdiction of the European Court of Justice, it also acknowledges the importance of consistency between the court and British courts. Where there is a ‘common rulebook’, the British courts are expected to pay ‘due regard’ to the European Court of Justice jurisprudence, which raises the question of how this approach will end the European Court’s jurisdiction in anything but name.
