Our house is not registered on the land registry
Partner John Stephenson John Stephenson outlines the process for registering a property with the Land Registry in response to a reader’s question in The Sunday Times.
The reader had settled their mortgage over 20 years ago and was concerned to be advised by their previous lender that the property was unregistered.
John Stephenson comments:
‘Registration of title is essential after any principle land transaction now – purchase, lease, mortgage – and other transactions can (and should) also be protected by the appropriate entry at the Land Registry, such as the interests of joint owners, lease extension and freehold clams; contracts affecting the land such as options; third party interests such as overage rights or the need for a covenant to pay maintenance costs; and many others.’
