Property litigation: private roads and potholes. Whose responsibility is it?

A reader’s question in the Sunday Times concerns a private road with potholes. Having asked their neighbours to contribute towards payment to repair the road, the neighbours have refused. The reader therefore asks whether they can force them to contribute.
Our partner Simon Painter responds, stating that firstly they need to identify who owns the road which may involve searching at the Land Registry, or if the land is unregistered, reviewing their title deeds, which can indicate who has responsibility for the road maintenance.
