    How long does divorce take?

    Divorce in England & Wales takes a minimum of 6 months, except in very limited circumstances where the Court will agree that this timeframe can be reduced (i.e. significant ill-health). That being said, things can take a lot longer depending on the approach taken by you and your spouse and the quality of the legal advice and support you receive.

    Separating your finances and making arrangements for any children you have can also take longer, especially if Court proceedings are required.

    If you wish to avoid lengthy divorce proceedings, there are various options we can offer to help speed up the process. Our divorce lawyers are trained in methods including mediation, collaborative law, instructing arbitrators and private financial dispute resolution, all of which can allow you to agree the details of your separation quickly and privately, without the need for contentious Court proceedings.

    Do you need to go to Court to get divorce?

    The majority of divorces in the UK no longer require contentious Court proceedings to deal with issues such as separating your finances or formalising arrangements for children as these can be resolved through alternative dispute resolution outside of a Court setting.

    There are, however, still many circumstances where Court proceedings may be the best or only option, so it is important to be prepared for this eventuality, even if you believe you are likely to be able to resolve matters privately.

    What are the grounds for divorce?

    There is only one legally accepted ground for divorce, which is that your marriage has irretrievably broken down. You do not need to provide any evidence of why this is the case. A statement from you (or jointly with your spouse if you are jointly applying for divorce) is all that is required.

    Can I get a no fault divorce?

    Yes. Since the introduction of the Divorce, Dissolution and Separation Act 2020 on 6 April 2022, all divorces in England & Wales are now “no fault”, as there is no longer a need to “prove” the reason that your marriage has broken down. This has also removed the possibility for a spouse to contest the divorce and taken away the need for one party to “take the blame” for the marriage ending. As a result, divorce should be a simpler and less stressful process, with the emphasis being on working collaboratively with your spouse to achieve the best for your family as a whole.
