Services

Owen advises UK domiciled clients on wills, trusts, powers of attorney, tax planning and the administration of estates. He specialises in the long term protection of wealth between generations, merging technical advice as to tax efficiency with each family’s differing circumstances. Many of the families he acts for, or their trustees, own private family businesses, landed estates and significant chattels collections or heritage property, leading Owen to focus on maximising the availability of agricultural and business property reliefs and IHT heritage schemes.

He particularly enjoys advising on and drafting wills and Letters of Wishes for those who have non-standard circumstances, such as those who have significant business or agricultural interests which attract specific IHT reliefs, advising on the use of trusts rather than outright inheritance for beneficiaries who could not cope with significant amounts too soon, or specific drafting for second marriage situations where a testator wants to provide for a surviving spouse but ring fence capital for children of the first marriage.

He is experienced in advising entrepreneurs at all stages in the lifecycle of their business. For example, an efficient will, personal tax strategies around sale, or how to manage the succession of the business down to the next generation of the family.

  • Acting for a family which the firm has advised for more than 100 years and the trustees of its eight family trusts in relation to trust and estate planning where the wealth includes a rural estate split between various trusts and a significant collection of chattels.
  • Advising on the inheritance tax aspects and creation of a Vulnerable Person’s Trust and the associated variation of a beneficiary’s interest in a deceased relative’s estate to settle into the new trust.
  • Advising the trustees of a UK private trust on the trust aspects of being asked to pledge their shares in a multinational company as security for the company’s borrowings and the drafting of the indemnity given by the beneficiaries to the trustees allowing the trustees to proceed with the corporate activity.
  • Acting for the Executors of an estate where a collection of letters from a former Poet Laureate were given to the nation in lieu of inheritance tax.
  • Acting for the Executors of an estate which includes a claim for conditional exemption from Inheritance Tax for land of outstanding natural beauty, including liaison with HMRC and advice on the content of the Heritage Management Plan.
