Amazon loses trade mark appeal over ‘targeting’ UK shoppers
This week, Amazon lost an appeal against a ruling that it had infringed UK trade marks by targeting British consumers on its U.S. website. The judgment is potentially significant for other online retailers, who will now be reviewing whether their platforms target British consumers.
In articles for Reuters, World Trademark Review, World Intellectual Property Review and Computing, partner in our Intellectual Property team, Dennis Lee, comments that the ruling may prompt similar lawsuits against other online retailers. Any online platform offering shipping to the UK ‘will now need to be clear that it is not “targeting” UK shoppers’, Dennis states, and if it does, retailers must ensure that the goods do not infringe UK trade marks.
