Can I put my neighbour’s rubble in his garden?
Property disputes partner Simon Painter answers a reader’s question regarding the legalities of moving the rubble created by a collapsed neighbour’s wall in an article for The Sunday Times.
Drawing on historical landmark cases, Simon comments:
‘… the rubble from the wall in this situation is both a trespass on and causing a nuisance to someone else’s land. Trespass arises because the neighbour’s rubble is on land that does not belong to him (the reader’s garden), without permission. Since the neighbour knows about it and refuses to remove the fallen stones, each day brings a new trespass.’
